Simpler — HR & compliance

Does every employee have signed written particulars of employment (an employment contract) on file?

Are you registered with both the UIF and the Compensation Fund (COIDA), with contributions, declarations and the annual Return of Earnings up to date?

Is every employee paid at least the current national minimum wage, or any higher sectoral or bargaining council rate, for every ordinary hour worked?

Have you registered your Information Officer with the Information Regulator and put POPIA-compliant privacy notices and security controls in place for employee records?

Safer — Health & safety

If you have more than 20 employees at a workplace, have you designated health and safety representatives in writing, and set up a health and safety committee where there are two or more?

Where more than 5 people work, do you have stocked first-aid boxes — and where more than 10 work, enough certified first aiders available on every shift (at least 1 per 50 employees, or 1 per 100 in shops and offices)?

Have you identified the hazards in your work, assessed the risks and put controls in place, as section 8(2)(d) of the OHS Act requires — and recorded it in writing?

Do you have a written emergency and evacuation plan, serviced fire equipment and trained fire-fighting and evacuation staff, with regular drills?

Do you have a written disciplinary code and grievance procedure that every employee has received and acknowledged?

Are your managers trained to run fair disciplinary processes under the 2025 Code of Good Practice: Dismissal, and do you keep signed records of warnings, enquiries and outcomes?

Do you have a clear process to diarise CCMA referrals and set-down notices, prepare witnesses and documents, and send a representative who may lawfully appear?

For employees earning at or below the BCEA earnings threshold, is every fixed-term contract in writing, stating a genuine, justifiable reason for the fixed term?
